Charges Dropped in Drugged Skater Case
June 9, 2008, 8:35 PM PDT

SANTA ANA -- Orange County prosecutors have dropped all charges against a man who was suspected of drugging two-time Olympic gold-medal-winning ice dancer Oksana Grishuka.

Prosecutors say they did not have enough evidence to proceed with the case against James R. Halstead, who had been scheduled to be arraigned this morning.

Grishuk, 36, who won two gold medals for Russia in the 1990s, told investigators in April that she had been drugged during a business meeting with a male acquaintance at the St. Regis Monarch Beach hotel in Dana Point. While sipping wine, she noticed a pill at the bottom of her glass and began to feel ill.

Tests determined that the pill was similar to Rohypnol, commonly used as a date-rape drug, Amormino said.

Prosecutors say there was no doubt that somebody slipped a drug into Grishuk's drink at the hotel on April 12, but there were no eyewitnesses who could prove that Halstead was the one who put it in there.

Michael Molfetta, Halstead's defense attorney, called the case a "piece of junk" and said that two tests of Grishuk's blood came back negative for Nimetazepam.

He also said that Halstead and Grishuk had had a lengthy romantic relationship and he had provided text messages, e-mails, telephone records and personal notes to the district attorney's office to prove it.

Grishuk denied a romantic relationship with Halstead during a news conference at the Sheriff's Department last month.

Halstead said Grishuk wanted to marry him, but he was going through a divorce and told her no. He also said she wanted him to travel to Europe with her as her agent, but he refused.

Halstead said Grishuk initiated the April 12 meeting at the St. Regis because she accused him of missing Valentine's Day.

He said he believes she slipped the pill in her own drink when he left to use the restroom for about 15 minutes.

"We seemed to be having a nice time. Next thing you know, she reaches into the glass and pulls out this pill and says, 'What is this?"' Halstead said. "I don't why she did this, whether she was mad at me or crazy. It doesn't make any sense."

Halstead had been charged with a felony count of administering a drug with the intent to commit sexual assault. He could have faced up to three years in prison if convicted.
